This page contains the terms & conditions.These Terms should be read carefully by you before you place an order for Artworks from ARTinTRA. You should understand that by ordering any of our products, you agree to be bound by these terms & conditions.

By placing an order at ARTinTRA, you warrant that you are at least 18 years old (or have parents' permission to buy from us) and accept these terms & conditions which shall apply to all orders placed or to be placed at ARTinTRA for the sale and supply of any products. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.

Ordering Artworks   

To place an order with ARTinTRA you will need to do this by following the ordering procedure on the Website.

Following receipt of your written Order, ARTinTRA will then confirm acceptance of your Order by issuing an ‘Order Confirmation Email’. Pending issue of the Order Confirmation Email ARTinTRA shall not be under any obligation to accept your Order; once your order is accepted a contract of sale will exist.

All Artworks are subject to availability. If on receipt of your order the Artworks you have ordered are not in stock, ARTinTRA will inform you as soon as possible.

The description of the Artworks you order will be as shown on the Website at the time you place your order.

The purchase price of the Artworks will be the price stated on the website, which will state whether VAT (or other sales tax) is applicable. All purchase prices are exclusive of delivery charges (if applicable), which will be added to the order at the amounts indicated on the Website or - if for packages of more than 2kg weight -  as agreed between the buyer and ARTinTRA.

During the checkout process, you will be asked to enter your payment details. By completing your payment details you confirm that the credit or debit card being used is yours. All fields indicated as compulsory must be completed. Please note that we may collect and store your personal information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy Policy.

Where the Artworks are supplied for export from the EU, you will be responsible for complying with all applicable laws and regulations governing the importation of the Artworks into the country of destination and for the payment of any import duties or taxes which are levied on them.

Delivery and risk                                                                             The Artworks will be delivered to the delivery address stated in the Order.

Every effort will be made to deliver the Artworks by the dates or within the time periods specified on the website but these cannot be guaranteed. If delivery cannot be arranged within such time periods, ARTinTRA will endeavour to inform you as soon as possible of any revised delivery date(s).

You will become the owner of the Artworks only upon payment in full of the sale price.

You will be responsible for risk of loss or damage to the Artworks once they have been delivered to you.

Deliveries                                                                                             Delivery will be to the UK or international address specified in your order. If no one is available at a residential or other address at the time of delivery, a note will be left to advise whether your order has been left in a safe place e.g. with a neighbour, or returned to depot.

We shall be under no liability for any delay or failure to deliver Artworks if the delay or failure is wholly or partly caused by circumstances beyond our reasonable control.

In the UK, delivery charge refunds can only be made in accordance with your legal rights under the Consumer Protection (Distance Selling) Regulations 2000 and other applicable legislation. Similar rights may apply for some international deliveries.

Intellectual Property                                                                       In purchasing any Artworks, you are not granted any right to any copyright or other intellectual property rights in the Artworks, which remains at all times with the Artist.

In respect of any Artwork purchased by you, on behalf of the Artist we hereby asserts the Artist’s right to be identified as the creator of the Artwork whenever the Artwork is displayed in public or reproduced.

Liability &  Force Majeure                                                                 Nothing in this clause  or otherwise in these Terms shall exclude or limit our liability for: death or personal injury caused by our negligence; or for fraud or fraudulent misrepresentation; or breach of the terms implied by section 12 of the Sale of Goods Act 1979.

ARTinTRA hereby excludes any liability for any business loss or damage or any indirect or consequential loss or damage suffered by you in connection with the supply (or non-supply) of the Artworks, including loss of revenue, loss of profit, or loss of business, and whether caused by tort (including negligence), breach of contract or otherwise.

ARTinTRA shall not be held responsible for any delay or failure to comply with its obligations under these Terms if the delay or failure arises from any cause which is beyond ARTinTRA’s reasonable control.

Events outside ARTinTRA's control, which is not reasonably foreseeable, shall be considered force majeure, meaning that ARTinTRA is released from ARTinTRA's obligations to fulfill contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc. 

Personal Information
All personal information you provide us with or that we obtain will be handled by ARTinTRA as responsible for the personal information. The personal information you provide will be used to ensure deliveries to you, the credit assessment, to provide offers and information on our catalog, events and activities to you. The information you provide is only available to ARTinTRA and Tictail (our online shop service provider) and will not be shared with other third parties. You have the right to inspect the information held about you. You always have the right to request ARTinTRA to delete or correct the information held about you. By accepting the ARTinTRA Conditions, you agree to the above.

All products remain ARTinTRA's property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognized before confirming the purchase. If you are under 18 years old you must have parents' permission to buy from ARTinTRA.

All transfers conducted through ARTinTRA are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway choosen for the transaction as they are responsible for the transactions made.

Local Taxes
Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers' own expense.

Additional Information
ARTinTRA reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is sold out, ARTinTRA has the right to cancel the order and refund any amount paid in the best way. ARTinTRA  shall also notify the customer of equivalent replacement products if available.
